These Terms of Use apply to Nihonary (bundle identifier com.jolous.nihonary), published and operated by Minh Thu Nguyen, an individual developer (“the Developer,” “we,” “us,” or “our”). Jolous is the family domain used for support email and is not identified here as a separate legal entity. By downloading or using Nihonary, you agree to these terms and Apple’s applicable App Store terms and standard end-user license agreement.
License and permitted use
Nihonary is licensed, not sold. Subject to these terms and Apple’s usage rules, you receive a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control for lawful personal language learning.
You may not copy, redistribute, rent, sell, sublicense, reverse engineer, bypass access controls, interfere with operation, manipulate purchases or advertising, extract lesson assets for redistribution, or infringe intellectual-property or other rights, except where applicable law expressly permits an action that cannot be restricted by contract.
Educational scope
Nihonary provides a structured beginner Japanese course designed around JLPT N5-level language. It is an educational aid, not an accredited school, examination provider, translation service, or guarantee of any test result, fluency level, academic credit, employment outcome, or immigration outcome. Learners should verify critical translations or guidance with qualified sources.
Lesson content and artificial intelligence
Nihonary includes original lesson text, mapped learning guidance, illustrations, and character-based audio. Lesson voices are AI-generated, and artificial-intelligence tools may assist in creating or refining lesson text and artwork. The content is reviewed as educational material, but it may contain pronunciation, visual, or interpretation errors. Artwork and audio are creative educational materials and should not be treated as recordings of real people or events.
Learning progress and iCloud
Progress is stored locally and may optionally sync through Apple’s iCloud key-value store. You are responsible for maintaining access to your Apple Account, device, and backups. Although Nihonary is designed to preserve valid learning data, uninterrupted sync, immediate delivery, or recovery of every local record cannot be guaranteed.
You may disable sync or delete learning data through Settings. Rewarded-ad Review unlocks remain device-only unless the Remove Ads entitlement unlocks all Reviews.
Advertising and rewarded Reviews
Chapters 4–40 may show one interstitial advertisement before entry. No ads appear inside manga pages. A learner may voluntarily watch a rewarded advertisement to unlock a chapter Review. Ad availability depends on Google, network access, privacy choices, region, and inventory.
A Review unlock is granted only after the advertising service reports completion. Closing an ad early or an ad failing to load may leave the Review locked. Chapters 1–3 do not show chapter-entry interstitials.
Remove Ads purchase
Remove Ads is a one-time, non-consumable in-app purchase. It removes chapter-entry ads and unlocks all Reviews for the Apple Account associated with the verified transaction. The price displayed by the App Store is the applicable price and may vary by storefront, currency, and tax.
Purchases and restoration are processed by Apple. The Developer does not receive payment-card details. Refund requests and billing disputes are subject to Apple’s policies. The purchase does not transfer ownership of Nihonary or provide rights to separate future products.
Third-party services
Nihonary relies on Apple services for distribution, purchases, entitlement verification, and optional iCloud sync, and on Google AdMob for advertising. Your use of those services is also governed by their applicable terms and privacy policies. Availability or behavior controlled by a third party may change independently of the Developer.
Ownership
Nihonary, its original code, name, icon, interface, lesson structure, text, artwork, audio assets, characters, and other original materials are owned by Minh Thu Nguyen or the applicable licensors and are protected by applicable intellectual-property laws. Open-source components remain governed by their own licenses.
Updates and availability
The Developer may maintain, correct, update, add, remove, or discontinue features or content when reasonably necessary for accuracy, compatibility, security, legal compliance, third-party service changes, or product improvement. Reasonable efforts will be made not to remove the core benefit of an existing non-consumable purchase, subject to law and circumstances outside the Developer’s control.
Warranty disclaimer
To the maximum extent permitted by law, Nihonary is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free content, fitness for a particular purpose, merchantability, non-infringement, or guaranteed educational results. Nothing in these terms excludes warranties or consumer rights that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, the Developer is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of or inability to use Nihonary, including loss of local progress or reliance on educational content. Any limitation applies only to the extent allowed in your jurisdiction.
Termination
Your license may end if you materially violate these terms. Upon termination, you must stop using and delete the app. Provisions that by their nature should survive—such as ownership, disclaimers, and limitations—remain effective. You may stop using Nihonary at any time by deleting it.
Changes and general terms
We may update these terms to reflect app, service, content, or legal changes. Material changes will be communicated through the app or store listing when appropriate. If a provision is unenforceable, the remaining provisions continue to apply. Mandatory consumer protections in your country remain unaffected.
